Terms of Use

Hawa is a catalog and suggestion service for independent wellness practitioners and curated sanctuaries. We run a quiz, and we show you the people and places we think might fit. That's the extent of our role. If something looks right to you, reaching out is entirely up to you; we don't make introductions, vouch for anyone to the other party, or get involved once you've made contact.

Hawa also curates a library, the Reading Room, containing podcasts, books, articles, and links to other sources across the eight wellbeing pillars. This library is provided for general informational and educational purposes only. We do not create most of this content ourselves, we do not control it, and we do not guarantee its accuracy, completeness, or suitability for you. Links to external sources take you off the Platform and outside our control entirely.

We do not process payments, take bookings, or handle any part of the transaction between you and a practitioner or sanctuary. Every session, retreat, price, schedule, and payment is arranged directly between you and them, entirely outside the Platform. At this time, Hawa takes no commission or fee from these arrangements.

You need to be 18 or older. Using Hawa means you're confirming that's true.

The people and places listed on Hawa are independent. They're not our staff, our contractors, our partners, or our agents, and we don't direct, train, supervise, or oversee how they run their sessions or their properties. Nothing in these terms creates an employment, agency, partnership, or joint venture relationship between Hawa Being and any practitioner, sanctuary, or user.

We may speak with practitioners or look into a sanctuary before listing them, and that gives us a general sense of who they are. It is not a certification, a license verification, a background check, a credential check, or a guarantee of their skill, safety, legality, or conduct, past or future. Listing on the Platform is not an endorsement. The full detail on this lives in our Wellness Disclaimer, which is part of these terms just as much as this page is.

Use the Platform for what it's meant for: finding wellness support. Be honest in what you tell us and what you tell practitioners. Don't use the Platform to harass, defraud, or exploit anyone listed on it, don't scrape, copy, or repurpose our content or listings commercially, and understand that whatever you decide to do with a practitioner or sanctuary you find through Hawa is entirely your decision, made at your own discretion and your own risk.

You understand and agree that connecting with any practitioner or sanctuary, and everything that follows from that connection, carries inherent risk, including but not limited to physical, emotional, psychological, financial, and legal risk. You voluntarily and knowingly assume all such risk. You are solely responsible for evaluating whether a given practitioner or sanctuary is suitable, safe, qualified, and appropriate for you before engaging with them, and for any decision you make to proceed.

Nothing on the Platform, whether that's a quiz result, a suggestion, or something you read in the Reading Room, is medical, psychological, legal, or financial advice, and none of it should be relied on as such. Again, the Wellness Disclaimer goes into this properly.

The design, writing, branding, and content of the Platform belong to Hawa Being or to whoever we've licensed it from. You're welcome to enjoy it, but reproducing, copying, or repurposing it, in whole or in part, without our written permission isn't allowed.

Practitioner and sanctuary profiles are written by them or compiled from what they've told us. We do not independently verify, and do not guarantee, the accuracy, completeness, or currency of anything in a listing, including claims about qualifications, experience, pricing, or availability. Confirm anything that matters to you directly with the practitioner or sanctuary before proceeding.

If you come across a listing, profile, or piece of content on the Platform that you believe is illegal, fraudulent, or otherwise breaches these terms, tell us at hello@hawabeing.com with enough detail for us to locate it (a link, a name, or a screenshot helps). We'll review reports in a reasonable timeframe and may remove or restrict content, suspend a listing, or take other action we consider appropriate. Submitting a report doesn't obligate us to act in any particular way, and we're not liable for content we haven't been made aware of or haven't had reasonable time to review.

The Platform, and everything on it, is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Hawa Being disclaims all warranties, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that any practitioner or sanctuary will meet your expectations, or that any suggestion, quiz result, or piece of content will be accurate, complete, or suitable for your circumstances.

To the fullest extent permitted by law, Hawa Being, its founders, employees, contractors, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or opportunity, however arising, whether in contract, tort (including negligence), strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages, arising out of or in any way connected with:

• your access to or use of, or inability to access or use, the Platform
• any practitioner, sanctuary, listing, quiz result, suggestion, or content on the Platform
• any session, service, retreat, booking, or interaction you have with a practitioner or sanctuary, whether found through the Platform or otherwise
• any conduct, statement, act, or omission of any practitioner, sanctuary, or other user

This limitation applies regardless of the theory of liability and even if a remedy fails its essential purpose. Where liability cannot be excluded under applicable law, Hawa Being's total aggregate liability arising out of or relating to the Platform or these terms is limited to the greater of the amount you have paid Hawa Being directly in the twelve months before the claim arose, which today is nothing, or the equivalent of fifty euros.

To the fullest extent permitted by law, you release Hawa Being, its founders, employees, contractors, and affiliates from any and all claims, demands, losses, damages, rights, and causes of action of every kind and nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to disputes, disagreements, or interactions between you and any practitioner, sanctuary, or other user of the Platform. If you are a resident of a jurisdiction that requires a specific statement to make this release effective as to unknown claims, that statement is deemed included here and you waive the protection of any such statute.

You agree to defend, indemnify, and hold harmless Hawa Being, its founders, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform, your violation of these terms, your violation of any right of a third party, or your engagement, dispute, or interaction with any practitioner or sanctuary found through the Platform.

We can suspend or close your access to the Platform at any time, with or without notice, if we believe you've broken these terms or caused or risked causing harm to Hawa Being, our users, or our practitioners. Sections of these terms that by their nature should survive termination, including assumption of risk, release, indemnification, limitation of liability, and governing law, will survive.

We may adjust, pause, or shut down parts of the Platform at any time and without liability for doing so, and we'll update these terms as needed too. The date at the top tells you when that last happened. Using the Platform after a change means you accept the new version; if you don't agree with a change, your only recourse is to stop using the Platform.

Hawa Being is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, internet or hosting outages, acts of government, or other events of a similar nature.

These terms, and any dispute arising out of or relating to them or the Platform, are governed by the law of Bulgaria, without regard to conflict of law principles. Any dispute that cannot be resolved directly falls under the exclusive jurisdiction of the courts of Bulgaria.

If any provision of these terms is found unenforceable by a court, that provision will be limited or removed to the minimum extent necessary, and the rest of these terms will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These terms, together with the Wellness Disclaimer, Privacy Policy, and Cookie Policy, are the entire agreement between you and Hawa Being regarding the Platform.
